This agreement contains important contractual rights, obligations and conditions between you, the user, and thewebman.co.za. Your acceptance of the terms of this user agreement is required for your continued use of this website.
While reasonable measures have been taken by thewebman.co.za to ensure the integrity of this website and its contents, no warranty, express or implied is given that it is free from viruses, trojans, bombs or any type of code or data that may corrupt, damage or effect the operation of the user's system.
Intellectual Property Rights and Licence:
All content, data and images on this website, including but not limited to, software, databases, text, graphics, icons, hyperlinks, private information, and designs, are the property of thewebman.co.za and as such, are protected from infringement by domestic and international legislation and treaties. Unauthorised copying of content, information, images, software, or file(s), including content, information, images, software, or file(s) that have been amended, modified, combined or included with such content, information, images, software, or file(s), or the written materials associated therewith is expressly prohibited unless such permission was granted in writing.

We, here at thewebman.co.za, respects the privacy of our customers and visitors.
We will not share your personal information without your written consent except where compelled to do so through due legal process.
When you complete an online form on this website, our website may collect personal information such as names, email addresses etc. from you, but only once submitted. This data is used solely by ourselves, only for the purpose that required the form to be submitted and for no other reason.
When you browse our website, servers will collect information about the device you are browsing from, so that we can analyse the use of our website. This information is stored as a "cookie" (a small file stored by your browser on your hard drive).
The information gathered in a cookie is not personal. You may choose not to allow your browser to accept cookies. To do this you need to change the settings on your browser, on your computer. We have no control over that.
The data that we collect is not shared, traded, or sold to third parties. We also do not use any of the above-mentioned information to generate advertisements.
Where we provide hosting services to a client, all personal information is encrypted as it is transmitted over the internet. All our information is encrypted by default, and protected by firewalls. Access to personal information is limited to an absolute minimum and only by authorised personnel. Despite these measures, we cannot warrant that your information will be 100% secure, but will do our best to do so.
Our website may contain links to other websites. Please note that when you click on one of these links, you are entering another website, for which we are not responsible.
Even though hosting is only about the rental of space on a computer somewhere, there are a few important points to take note of.
You are free to use your website for any purpose. However, the following is not permitted:
- any material of pornographic nature
- any material that I decide, in my sole discretion, as being improper, Racist, intolerant, "hate", defamatory or threatening
- storing or posting of content or links to content that infringe, or otherwise violate, the intellectual property rights of third parties (e.g. trademark, patent or copyright infringements)
Website Uptime and/or Downtime:
A server is just another computer, and computers, as we know, do sometimes fail to perform. Hosting service providers run various duplicate systems and should one system fail there will normally be another to continue keeping your website alive. All the hosting services that I contract have "99% uptime guarantees". Hosting providers however do not guarantee downtime as a result of situations that they cannot control such as
- natural disasters
- fibre-optic main line cuts
- Registrar issues with your domain name
You are ultimately responsible for the files of your website. The hosting service providers do make backups, but there are no guarantees that the backup they have is the latest version of your website. When I develop your website, I do keep a backup away from the server. Should you want to keep an additional backup, please ask.
SPAM and Unsolicited Commercial Email:
None of us like SPAM or Unsolicited Commercial Email(UCE). Niether does the Hosting service providers. Most of the hosting service providers take a zero tolerance approach to the sending of UCE or SPAM through their networks and services. In fact, if these activities originate from your website, and investigations show that to be the case, the Hosting companies are likely to terminate your service.
You may cancel the hosting account at any time by giving 30 days notice in writing and I will refund a pro-rata hosting fee, subject to a maximum of 50% of the original fee charged.
In the unlikely event that
- the account is abused in any way
- inappropriate content is placed on the website
- the mail server is used to generate SPAM
I reserve the right to cancel the hosting immediately with no refund in fees.
If you are aware of any abuse of your website, you are welcome to report it, with full details, to: abuse @ thewebman.co.za where appropriate action will be taken and you will be informed of the outcome.
Unless agreed to in writing, these payment terms are applicable for the services I provide:
Domain Registration, Hosting and Security certificates:
These are services that I source from outside contractors. Payment to them is made annually in advance and for no other reason, I charge you in advance. If payment is not received by me in time, or if no specific arrangements have been made, the service may be suspended or even cancelled.
Web design and development:
This is payment for my time and expertice. I would normally require a deposit of at least 50% of the quoted fee before I start any work. The balance is payable upon satisfactory completion of the work, or 60 days after payment of the deposit, whicever comes first.
This is an annual payment, payable on invoice. Outstanding payment may result in a delay in respect of the service required.
How payment is made:
For both Local and International clients, I provide an online payment facility, details of which is clearly shown on invoices submitted. Payment can be made by Debitcard, Credit Card or EFT.
Payments are made annually in advance.
If requested, and I do agree, it may be possible to arrange for monthly payments, subject to the following:

- bespoke websites, using mainly html & css (without using wordpress)
- e-commerce sites using opencart as base.
